Establishment of an entrepreneurial agency, obtaining a temporary residence permit and a work permit for foreigners –  Law Office Belgrade Knezevic

If you are a foreigner who wants to establish its own entrepreneurial agency for the purpose of obtaining a temporary residence permit based on self-employment and for obtaining a work permit in Serbia, this is an article for you.

Apart from self-employment grounds, a temporary residence and work permit may also be granted on the basis of employment in Serbia and on the basis of assignment to work in Serbia, in which case the list of required documentation is slightly longer than for the case of self-employment.

It should be noted that for a stay of up to 90 days in Serbia, no special approval from the Ministry of Interior (MUP) is required, while for a stay longer than 90 days it is necessary to have one. Temporary residence may be granted for a period of one year, after which it may be extended for the same period.

Establishing an entrepreneurial agency

The establishment of an entrepreneurial agency is carried out before the Business Registry Agency (BRA) and the procedure is performed within a few days. The following documents need to be submitted: completed registration application, a copy of the passport, and a proof of the paid fees, while after the registration it is necessary to obtain a stamp.

Temporary residence permit

The request for a temporary residence permit is submitted to the Administration for Foreigners at Ministry of Interior. If the request is submitted on the basis of self-employment, i.e. registered entrepreneurial agency, it is necessary to submit the following documentation:

  • completed application for a temporary residence permit
  • copy of the passport (original to be submitted for review)
  • excerpt from the BRA for the entrepreneurial agency
  • proof of payment of fees
  • copy of “white card”
  • certificate of bank account turnover for the entrepreneurial agency
  • confirmation of available funds on the account
  • document regulating health insurance in Serbia
  • two photos 30×40 mm
  • business resume (CV)

Obtaining a work permit

Upon obtaining the temporary residence permit, a request for obtaining a work permit should be submitted to the National Employment Service (NES). If the request is submitted on the basis of self-employment, i.e. registered entrepreneurial agency, it is necessary to submit the following documentation:

  • excerpt from the BRA for the entrepreneurial agency
  • copy of the passport
  • statement on the type, duration and scope of the entrepreneurial agency activity
  • statement on available equipment for performing the activity
  • foreigner’s degree with a certified translation by the official court interpreter
  • lease contract for business premises
  • proof of payment of fees

The entire procedure for issuing a work permit lasts several days and the permit is issued for the period for which temporary residence was granted.
